Is It Worth Using Premium Processing For Your EB-1A Visa?

HoldingUSFlag

Premium processing is a service that expedites the process of obtaining an EB-1A visa. But, even though premium processing is effective, it may not always be necessary.

Going over whether or not it is worth using premium processing for an EB-1A visa, and speaking with a lawyer, will make it easier to obtain an EB-1A visa.

 What Is The EB-1A Visa?

The EB-1A visa is a visa that allows immigrants to live and work in the United States.

If an immigrant wishes to obtain an EB-1A visa, they must possess an extraordinary ability. And, then, they must demonstrate that they possess this ability.

Some of the criteria that an immigrant must satisfy, in order to obtain an EB-1A visa, are as follows:

  • Receiving a lesser nationally, or internationally, recognized prize or award for excellence.
  • Being a member in field-related associations that demand outstanding achievements in their members.
  • Published material, in major trade publications or other major media, regarding their achievements.
  • Having been asked to judge the work of others, either individually or on a panel.
  • Having made scientific, scholarly, artistic, athletic, or business contributions of significance to the field.
  • Authoring scholarly articles in professional or major trade publications or other major media.
  • Having had one’s work displayed at artistic exhibitions or showcases.
  • Performing a leading or critical role in distinguished organizations.
  • Commanding a high salary or other significantly high remuneration in relation to others in the field.
  • Commercial success in the performing arts, if applicable.

If an immigrant satisfies at least three of the criteria outlined above, among several other requirements, then they can obtain an EB-1A visa.

How Long Does It Take The USCIS To Confirm Your EB-1A Visa Application?

The exact amount of time it takes the USCIS to confirm – or, for that matter, deny – one’s EB-1A visa application is dependent on a number of factors.

Even though the above is true, it will, generally speaking, take at least six months for your application to go through.

Sometimes, it can take even longer than that; up to 22 months, for example, although this is far from inevitable.

Outside of the above, it can take an immigrant at least one to three months to collect, and then organize, all of the documentation they need to obtain an EB-1A visa.

Is It Worth Using Premium Processing For Your EB-1A Visa?

To expedite the process of filing for, and obtaining, an EB-1A visa, it is possible for an immigrant to use premium processing.

The cost of premium processing is $2,500.

If an immigrant pays this fee, and files Form I-907, then they can receive a confirmation – or, of course, a denial, depending on the facts of the case.

Outside of the above, the best way for an immigrant to expedite the process of obtaining, organizing, and, then, filing the necessary documentation is to work with an immigration lawyer.

Premium processing may raise the likelihood of a Request for Evidence (RFE) issued by the United States Citizenship and Immigration Services (USCIS) requesting additional documentation or clarification to support an application.

A good immigration lawyer will streamline the process and ensure that an immigrant is able to obtain the visa that they desire in the best, and easiest, manner possible.
