  • The employment position has been offered to U.S. citizens and no candidates have come forward
  • Employing a foreign national for the position will not negatively affect the working conditions and wages of U.S. workers

Prospective employees must meet certain professional and educational requirements for the employment position. Potential employees must also maintain a legal status while residing in the United States.

Applying for PERM

Employers can file an Alien Employment Certification, ETA Form 9089. After being approved, the application must then be filed with the United States Citizenship and Immigration Services (USCIS) along with the Immigrant Petition for Alien Worker, Form I-140.

Employers can file the application for Permanent Employment Certification either by mail or electronically. In most cases, it is recommended that applications are filed electronically, as this method is more dependable than relying on the mail and is much faster. When filling out the application on the Department of Labor’s website, it is critical that it is filled out entirely. Incomplete applications will not be accepted by the system.
