Austin PERM Labor Certification Lawyer

Whether you are a foreign national who wants to work in the United States or you are an employer who wants to hire a worker in another country, it is important to speak to an Austin PERM labor certification lawyer. Immigration laws in the United States are extremely complex, and they are ever-changing. It is not always easy for individuals to make their way through the legal process without the help of a knowledgeable attorney.

Understanding PERM Labor Certification

Program Electronic Review Management (PERM) was designed by the United States Department of Labor (DOL) to streamline the process of filing labor certifications for foreign nationals. PERM has also standardized and enhanced recruiting requirements. PERM requires applications for labor certifications to be submitted online, with processing to occur within three months of the application being submitted. It is not usually necessary to file supporting documents with the application. However, if the application is subject to an audit, certain supporting documentation may be requested.

Qualifying for PERM

There are certain requirements for both workers and employers who wish to use the PERM labor certification process. Employers must show the following:

  • The job position being offered is full-time and is located within the United States
  • The job is a legitimate position available to citizens of the United States
  • The requisites of the employment position are not specifically customized to the qualifications of the foreign worker
  • The wage being offered must meet the current wage guidelines
  • The employment position has been offered to U.S. citizens and no candidates have come forward
  • Employing a foreign national for the position will not negatively affect the working conditions and wages of U.S. workers

Prospective employees must meet certain professional and educational requirements for the employment position. Potential employees must also maintain a legal status while residing in the United States.

Applying for PERM

Employers can file an Alien Employment Certification, ETA Form 9089. After being approved, the application must then be filed with the United States Citizenship and Immigration Services (USCIS) along with the Immigrant Petition for Alien Worker, Form I-140.

Employers can file the application for Permanent Employment Certification either by mail or electronically. In most cases, it is recommended that applications are filed electronically, as this method is more dependable than relying on the mail and is much faster. When filling out the application on the Department of Labor’s website, it is critical that it is filled out entirely. Incomplete applications will not be accepted by the system.
